These Terms and Conditions ("Terms") govern your use of the Toodles website and services ("Services"). By accessing the site, uploading illustrations, or purchasing products, you agree to be bound by these Terms. If you do not agree, please discontinue use of the Services.

2. Definitions

  • "Illustrations" refers to any images, designs, or creative content you upload.

  • "Products" are physical produced or fulfilled through Toodles (including Printful fulfilment).

  • "User", "you", or "your" refers to any person or entity accessing or using the Services.

  • "Order" refers to a purchase made through the Toodles website.

3. Eligibility

To use the Services, you must be at least 18 years of age or have consent from a parent or legal guardian. You are responsible for ensuring that any information you provide is accurate and complete.

4. User Responsibilities

You agree to:

  • Provide accurate and current information.

  • Use the Services only for lawful purposes.

  • Respect intellectual property rights of others.

  • Not upload harmful or offensive content, including material that is defamatory, obscene, hateful, or infringes third-party rights.

  • Ensure you have permission to upload illustrations, particularly if they include identifiable individuals (e.g., photos of children).

5. Illustration Submissions and Licensing

By uploading illustrations:

  • You retain ownership of your intellectual property.

  • You grant Toodles a worldwide, non-exclusive, royalty-free licence to use, reproduce, modify, adapt, and display the illustrations solely to provide the Services, including marketing your commissioned products, showcasing in galleries (if you opt in), and fulfilling orders.

  • You warrant that you have the necessary rights, permissions, and consents to grant the above licence and that your illustrations do not infringe third-party rights.

  • You may remove illustrations at any time, which will prevent new usage, though existing orders, marketing materials, and backups may continue to reference the illustrations as necessary for legal or operational reasons.

6. Orders, Pricing, and Payment

  • Prices are listed in Australian dollars unless otherwise stated and may change without notice.

  • Payments are processed by Stripe. By submitting an order, you authorise Stripe to charge the applicable amount.

  • Orders are subject to availability and confirmation. We may cancel or refuse orders (for example, due to suspected fraud or stock limits) and will notify you promptly.

  • Sales taxes, shipping fees, and import duties (if applicable) are your responsibility.

7. Production and Fulfilment

  • Most products are produced on-demand via Printful or similar partners. Production times vary and are estimates only.

  • We are not liable for delays caused by third-party manufacturers, shipping carriers, or events beyond our control.

  • Print colours and product appearance may vary slightly from digital previews.

8. Shipping, Delivery, and Risk

  • Shipping times depend on your location and carrier performance.

  • Risk of loss passes to you upon delivery to the carrier. Please ensure address details are complete and accurate.

  • You are responsible for customs duties, taxes, and clearance fees charged by your local authorities.

9. Returns, Refunds, and Replacements

  • Due to the customised nature of Toodles products, all sales are generally final.

  • We will replace or refund items that are defective, damaged in transit, or materially different from your order. Contact support@toodles.com.au within 14 days of delivery with photos and order details.

  • We may request the return of defective items before issuing replacements or refunds.

10. Promotions and Discount Codes

  • Promotional offers or codes are subject to specific conditions and may be withdrawn at any time.

  • Codes must be entered at checkout and cannot be applied retroactively.

  • We reserve the right to cancel promotions that appear to be misused or fraudulent.

11. Intellectual Property

  • All website content, trademarks, branding, and materials produced by Toodles are owned by or licensed to us.

  • You may not reproduce, distribute, or create derivative works without prior written permission, except as permitted by law.

12. Third-Party Services

  • Toodles integrates with third-party services such as Printful, Stripe, Resend, and analytics providers.

  • Third-party services may have additional terms that apply to you. We are not responsible for their content or performance.

13. Acceptable Use

  • You must not misuse the Services, attempt to gain unauthorised access, disrupt operations, introduce malware, or mine data.

  • Automated scraping, data harvesting, or commercial use beyond purchasing products is prohibited without our written permission.

14. Suspension or Termination

We may suspend or terminate access if:

  • You breach these Terms or applicable laws.

  • We suspect fraudulent activity or security risks.

  • We need to perform maintenance or address operational issues. You may also terminate your account by contacting us. Termination does not affect accrued rights or obligations.

15. Disclaimer and Limitation of Liability

  • Services are provided "as is" and "as available". We make no warranties regarding uninterrupted access, accuracy, or fitness for a particular purpose.

  • To the maximum extent permitted by law, Toodles is not liable for indirect, incidental, or consequential damages arising from use of the Services.

  • Our total liability for any claim shall not exceed the amount paid for the relevant order.

  • Nothing in these Terms excludes liability for death, personal injury, fraud, or other liability that cannot be excluded under applicable law.

16. Indemnity

You agree to indemnify and hold Toodles harmless against claims, damages, losses, and expenses arising from your breach of these Terms, infringement of third-party rights, or misuse of the Services.

17. Privacy
